By accessing our website or purchasing from Colonel Sloth, you agree to these Terms & Conditions. These Terms constitute a legally binding agreement.

1. Use of Website

• You must be 18 years or older to purchase. Minors may only use under parental/legal guardian supervision.

• You must not use the site for unlawful purposes including fraud, money laundering, intellectual property infringement, spreading malware, or offensive content.

• You are solely responsible for keeping your login details secure. Colonel Sloth is not liable for unauthorized access unless caused by our proven negligence.

• We may modify, suspend, or discontinue the website (or any part of it) at any time without notice.

• While we strive for accuracy, Colonel Sloth does not guarantee that all product descriptions, pricing, or availability information is error-free.

• You are responsible for complying with all local laws and regulations when using our website.

• We reserve the right to suspend or terminate accounts engaged in fraudulent, abusive, or unlawful activity.

2. Products & Orders

• Products are limited in quantity and availability is not guaranteed, even if displayed online.

• We reserve the right, at our sole discretion, to refuse or cancel any order without liability, including but not limited to cases of:

• Suspected fraud, abuse, chargeback risk, or misuse of promotions.

• Incorrect pricing, stock errors, or inaccurate product information (including descriptions, images, or specifications).

• An order is only considered binding once you receive an official confirmation email from Colonel Sloth.

• Prices may change at any time without prior notice. Applicable taxes and delivery charges will be added as required by law.

• Customers are solely responsible for providing accurate shipping and billing information. Colonel Sloth is not liable for delays, losses, or failed deliveries resulting from inaccurate or incomplete information.

• Promotions, discounts, and offers are subject to change or withdrawal at any time without notice and cannot be transferred or applied retroactively.

3. Returns, Refunds & Exchanges

• No returns, refunds, or exchanges are accepted for reasons of size, fit, color, or change of mind. Customers are expected to review our size chart and product details carefully before purchase.

• Returns are only accepted if the item is damaged or defective at the time of delivery, and such determination shall be made at Colonel Sloth’s sole discretion.

• Claims must be raised within 48 hours of delivery by emailing support@colonelsloth.com with clear photo and/or video evidence. We may request the item to be physically returned for inspection before a decision is made.

• Returned items must be unused, unwashed, and sent back with all original tags, labels, and packaging intact. Failure to comply will result in claim rejection without liability.
  

• If a return/refund is approved, the maximum remedy available to the customer is a refund of the product cost to the original payment method within 7–14 business days. Colonel Sloth reserves the right to issue store credit instead of a cash refund at its discretion.

• Refund amounts may be reduced by shipping fees, duties, handling charges, or payment gateway fees, unless the defect is conclusively proven to be our responsibility.

• Colonel Sloth will not accept claims for items damaged due to misuse, improper washing, accidents, negligence, or normal wear and tear.

4. User Obligations

• Products purchased from Colonel Sloth are strictly for personal, non-commercial use. Any resale, redistribution, or unauthorized commercial exploitation is prohibited unless expressly authorized in writing by Colonel Sloth.

• You must not upload, transmit, or share any content that:

• Contains viruses, malicious code, or harmful software,

• Is defamatory, abusive, obscene, or unlawful,

• Infringes or violates the intellectual property rights of third parties.

• You agree not to engage in any fraudulent activity, attempt to gain unauthorized access to our systems, misuse promotions, or otherwise disrupt the proper functioning of our website.

• You agree to comply with all applicable local, national, and international laws when using our site or purchasing products.

• To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Colonel Sloth, its affiliates, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from your misuse of the site, violation of these Terms, or breach of law, except where such claims directly result from our proven negligence or willful misconduct.

5. Liability & Disclaimers

• All products are sold on an “as is” basis. Minor variations in color, texture, finish, size, or weight from product images or descriptions shall not be considered defects. Product images are for illustrative purposes only.

• Colonel Sloth does not warrant uninterrupted, secure, or error-free access to its website or that defects will be corrected.

• Limitation of Liability: To the maximum extent permitted by law, our total cumulative liability for any claim, whether arising in contract, tort, or otherwise, shall not exceed the total amount paid by you for the specific order giving rise to the claim.

• We shall not be liable under any circumstances for any indirect, incidental, punitive, exemplary, or consequential losses, including but not limited to loss of profits, loss of business, loss of goodwill, reputational damage, or loss of data.

• Nothing in these Terms excludes liability where such exclusion is not permitted under applicable law, including obligations relating to defective goods under the Consumer Protection Act, 2019.

• Force Majeure: Colonel Sloth shall not be liable for any delay, failure, or disruption in performance due to causes beyond our reasonable control, including but not limited to natural disasters, strikes, lockouts, industrial action, cyberattacks, pandemics, government orders, supply chain disruptions, or technical failures. In such cases, Colonel Sloth may, at its sole discretion, either fulfill the order at a later date or issue a refund of the purchase price.

6. Privacy & Data Protection

• We collect personal data (including name, email, phone number, address, and payment details) solely for the purposes of processing orders, communicating with you, fulfilling services, and improving customer experience.

• Data is shared only with trusted third-party service providers (such as payment gateways, logistics partners, and analytics providers) who are bound by confidentiality and data protection obligations.

• We do not sell, trade, or rent your personal data to any third party.

• Data is retained only for as long as necessary to fulfill the purpose of collection, or as required for legal, tax, regulatory, or dispute resolution purposes.

7. Intellectual Property & User Content

• All intellectual property on this website, including but not limited to the Colonel Sloth name, logo, product designs, images, website content, and promotional materials, is the sole and exclusive property of Colonel Sloth, protected under the Indian Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable laws.

• Any unauthorized use, reproduction, modification, distribution, display, or exploitation of our intellectual property — including the creation of derivative works or use of confusingly similar marks — is strictly prohibited and may result in civil or criminal legal action.

• Products are sold strictly for personal use and may not be used for commercial resale, reproduction, or any unauthorized commercial purpose without prior written consent from Colonel Sloth.

• By submitting, posting, or sharing any content (including but not limited to reviews, testimonials, images, or social media posts) that reference Colonel Sloth, you grant Colonel Sloth a perpetual, non-exclusive, royalty-free, transferable, and worldwide license (with the right to sublicense) to use, reproduce, distribute, adapt, publish, translate, modify, display, and create derivative works from such content across any media platform for marketing, advertising, and promotional purposes.

• You represent and warrant that you own or have the necessary rights to the content you submit and that such content does not infringe the rights of any third party. You agree to indemnify and hold Colonel Sloth harmless from any claims or damages arising from your submitted content.

8. Fraud Prevention

• Colonel Sloth actively monitors transactions for fraudulent or abusive activity. Orders flagged for suspicious activity — including but not limited to multiple failed payment attempts, chargeback history, mismatched billing/shipping details, unusual purchase volumes, or misuse of promotions and discount codes — may be withheld, delayed, or cancelled at our sole discretion and without liability.

• Colonel Sloth reserves the right to request additional verification (such as government-issued ID or proof of address) before fulfilling an order. Failure to provide requested information may result in order cancellation.

• Any order determined to be fraudulent or abusive will result in immediate account suspension or termination, blacklisting from future purchases, and forfeiture of any payments already made.

• Colonel Sloth reserves the right to share relevant customer information with payment gateways, banks, courier partners, and law enforcement authorities for the investigation and prevention of fraud.

• Fraudulent activities may also lead to civil and/or criminal legal proceedings to recover damages, costs, and losses incurred by Colonel Sloth.

9. Termination

• Colonel Sloth reserves the right, at its sole discretion and without prior notice, to suspend, restrict, or permanently terminate your account, order, or access to our website and services if you:

• Breach or violate these Terms & Conditions,

• Engage in suspected or confirmed fraud, abuse, or unlawful activity,

• Act in a manner that harms Colonel Sloth’s reputation, operations, or customer trust.

• Termination does not limit or affect Colonel Sloth’s right to claim damages, recover outstanding payments, costs, or losses, or pursue any other legal or equitable remedies available under law.

• Customers remain liable for all obligations and charges incurred prior to the date of termination.

• Colonel Sloth shall not be held liable for any losses, inconvenience, or damages arising from account or order suspension/termination.

• Users terminated for cause may be blacklisted and permanently prohibited from future purchases.

10. Governing Law & Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

• The parties shall first attempt in good faith to resolve any dispute, claim, or controversy arising out of or relating to these Terms through written communication and amicable discussion.

• If such efforts fail, the dispute shall be finally resolved by binding arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.

• The seat and venue of arbitration shall be Bangalore, Karnataka.

• The arbitration proceedings shall be conducted in the English language.

• The arbitral tribunal shall consist of a sole arbitrator, jointly appointed by the parties; if the parties fail to agree, the arbitrator shall be appointed in accordance with the provisions of the Act.

• The arbitrator’s award shall be final and binding on the parties, with no appeal permitted except as provided under applicable law.

• Each party shall bear its own legal costs and expenses, unless otherwise directed by the arbitrator in the final award.

• For matters that are not subject to arbitration (including applications for interim reliefs), the courts in Bangalore, Karnataka shall have exclusive jurisdiction, to the exclusion of all other courts and tribunals.

11. Updates to terms and conditions

• Colonel Sloth reserves the right, at its sole discretion and without prior notice, to amend, modify, or update these Terms & Conditions at any time. Updated versions will display a “Last Updated” date at the top of the document.

• Significant changes may, at Colonel Sloth’s discretion, be communicated by email or through a notice on the website; however, it remains the customer’s responsibility to review these Terms regularly.

• All amendments shall apply immediately upon publication and shall apply to both existing and future users, accounts, and orders.

• By continuing to access or use our website, products, or services after updates have been published, you acknowledge and agree to be bound by the revised Terms. If you do not agree with the updated Terms, your sole and exclusive remedy is to discontinue use of our services.

12. Taxes

• All product prices displayed on the Colonel Sloth website are inclusive of applicable taxes under Indian law, including Goods and Services Tax (GST).

• A detailed tax breakdown will be provided only on the official invoice once an order has been successfully placed.

• Customers acknowledge and agree that prices shown at checkout already include applicable taxes, and no further itemized tax details will be shared in advance.

• Colonel Sloth reserves the right to collect any additional taxes, duties, or levies that may be imposed by law at the time of delivery or invoicing.

13. Shipping & Delivery Charges

• Colonel Sloth offers free standard shipping on all orders with a total value above ₹1,000 (after discounts, before taxes).

• For orders below ₹1,000, a flat shipping fee of ₹50 will be applied at checkout.

• Shipping charges are non-refundable in the event of a return, except where the product is proven defective and the claim is approved by Colonel Sloth.

• International customers (or domestic customers in regions subject to additional levies) are solely responsible for any customs duties, import taxes, clearance fees, or surcharges imposed by local authorities. These costs are not included in the product price or shipping fee and must be borne by the customer.

• Colonel Sloth shall not be liable for delays or additional charges resulting from customs clearance or regulatory processes.

14. Acceptance of Terms

• By accessing, browsing, or using the Colonel Sloth website, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

• By placing an order, you confirm your acceptance of these Terms & Conditions in full.

• If you do not agree with any part of these Terms, you must not use this website or make a purchase.

• Your continued use of our website and services following any updates to these Terms constitutes acceptance of the revised Terms.

16. Promotions, Discounts & Gift Cards

• All promotional codes, discounts, store credits, and gift cards are non-transferable, non-exchangeable, non-refundable, and not redeemable for cash or credit unless explicitly required by law.

• Colonel Sloth reserves the right, at its sole discretion, to suspend, modify, or withdraw any offer, promotion, or discount without prior notice, even after it has been advertised.

• Unless otherwise specified in writing, only one promotional code or discount may be applied per order. Discounts cannot be combined with other promotions, loyalty credits, or gift cards.

• Gift cards and discount codes must be redeemed within their validity period. Colonel Sloth is not responsible for expired or lost codes/cards.

• Misuse of any discount, code, or promotional scheme (including but not limited to multiple redemptions, fraudulent activity, or unauthorized sharing) will result in immediate cancellation of the order and may lead to account termination or legal action.

17. Third-Party Services & Links

• The Colonel Sloth website may contain links to third-party websites, applications, or services (e.g., courier partners, payment gateways, social media platforms). These links are provided for convenience only.

• Colonel Sloth does not control, endorse, or guarantee the accuracy, safety, legality, or practices of such third-party services.

• Your use of third-party services is at your own risk and responsibility, and any disputes must be resolved directly with the third party.

• Colonel Sloth is not liable for any loss, damage, or claim arising from your use of third-party services, including but not limited to failed payments, courier delays, or issues with external platforms.

18. Communication & Notifications

• Colonel Sloth will communicate with customers primarily via:

• Registered email addresses,

• Official WhatsApp account (messages only, no voice calls), and

• Notices posted on our official website.

• It is the customer’s responsibility to provide accurate, up-to-date contact details and to check their registered email/WhatsApp regularly. Colonel Sloth is not liable for undelivered communications due to outdated or incorrect contact details.

• Any communication sent by Colonel Sloth to your registered contact details shall be deemed received and acknowledged on the date it was sent, regardless of whether you read it.

• Customers may not opt out of essential service communications (order confirmations, legal notices, updates to Terms). Marketing communications may be opted out separately.

19. Severability & Waiver

• If any provision of these Terms is found by a court or authority to be invalid, illegal, or unenforceable, such provision shall be deemed severed and the remaining Terms shall remain valid and enforceable to the fullest extent permitted by law.

• No failure, delay, or partial exercise by Colonel Sloth in enforcing any right, remedy, or provision under these Terms shall be deemed a waiver of that or any other right.

• Any waiver must be expressly given in writing and signed by an authorized representative of Colonel Sloth.

20. Entire Agreement

• These Terms & Conditions, together with our Shipping Policy, Returns & Refunds Policy, Privacy Policy, and any other policies expressly referenced, constitute the entire and exclusive agreement between Colonel Sloth and the customer.

• This agreement supersedes any prior or contemporaneous communications, whether oral, written, or electronic, including statements made via email, WhatsApp, social media, or customer support.

21. Payments & RBI Compliance

• All online payments on Colonel Sloth are processed securely through RBI-authorized payment gateways.

• In compliance with RBI guidelines:

  • We do not store your card or payment details. Card details may be tokenized by authorized card networks for faster checkout.

  • All domestic card transactions require two-factor authentication as mandated by RBI.

  • Refunds, if approved, will be processed to the original payment method within 7–14 business days, depending on your bank/payment provider.

  • In the event of a chargeback or payment dispute, Colonel Sloth reserves the right to provide supporting documentation to the payment gateway and the decision of the issuing bank will be final.

• For UPI and wallet transactions, refunds will be credited to the same account/wallet used for payment.

• All payments are subject to RBI regulations, and Colonel Sloth complies with PCI-DSS standards to ensure data security.

No representation, statement, or assurance outside these documents shall be binding on Colonel Sloth unless expressly confirmed in writing by an authorized representative.
